1.Acceptance of Terms
By accessing or using the CreatorGPT platform ("Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use the Platform. These Terms constitute a legally binding agreement between you ("User") and Bluetik ("Company", "we", "us", or "our").
2.Use of the Platform
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not use the Platform to generate, distribute, or publish content that is unlawful, defamatory, obscene, fraudulent, or that infringes any third-party rights. We reserve the right to restrict or terminate access for any User who violates these Terms or applicable law.
3.User Accounts
To access certain features of the Platform, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. We are not liable for any loss or damage arising from your failure to safeguard your credentials.
4.Intellectual Property
All trademarks, logos, software, and content comprising the Platform (excluding User-submitted content and AI-generated outputs) are the exclusive property of Bluetik or its licensors. Nothing in these Terms grants you any licence or right to use our intellectual property without prior written consent. Subject to these Terms, AI-generated content produced through the Platform may be used by you for your own business or personal purposes.
5.Payment and Billing
Certain features of the Platform are offered on a paid subscription basis. All fees are stated in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise noted. Payments are processed through third-party payment providers. Subscription fees are non-refundable except as required by applicable law or as expressly stated in our Refund Policy. We reserve the right to modify pricing with reasonable advance notice.
6.Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, if you breach these Terms or if we determine, in our sole discretion, that your use poses a risk to the Platform, other users, or third parties. You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately.
7.AI-Generated Content
All content generated through CreatorGPT — including text, images, and videos — is produced entirely by artificial intelligence. Such content may contain errors, inaccuracies, or unintended outputs, and may not align with your expectations, brand guidelines, or intended message. Bluetik makes no representations or warranties regarding the accuracy, originality, suitability, or fitness for purpose of any AI-generated content. The User is solely responsible for reviewing, editing, and approving all content before publication or distribution. Bluetik assumes no liability for any consequences arising from the use, publication, or distribution of AI-generated content.
8.Disclaimers
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee that any results obtained from the use of the Platform will be accurate or reliable.
9.Limitation of Liability
To the fullest extent permitted by applicable law, Bluetik shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or business opportunities — arising out of or in connection with your use of or inability to use the Platform, even if advised of the possibility of such damages. Our aggregate liability to you for any claim arising under these Terms shall not exceed the amount paid by you to Bluetik in the three (3) months immediately preceding the event giving rise to the claim.
10.Indemnity
The User agrees to indemnify, defend, and hold harmless Bluetik, its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses — including reasonable legal fees — arising out of or in connection with the User's use of the Platform, any violation of these Terms, infringement of any third-party intellectual property or other rights, or the use, publication, distribution, or reliance on any AI-generated content produced through CreatorGPT. This obligation survives termination of the User's account or these Terms.
11.Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy. Please review the Privacy Policy carefully before using the Platform.
12.Modifications
We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting the revised Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform.
13.Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.
